现代大学“学术、行政、产业”三重属性的价值与法治的价值及其运行模式是相通相承、相互吻合的,其结果和效益亦是高度一致的。因而在我国现代大学的治理中应推行法治的运行模式,并通过法治内在的、特有的、完整的模式来实现现代大学的功能与目的。当然,由于大学是社会特殊的组织,而法治也是一种特殊的治理模式,一个特殊的组织与一种特殊的治理模式相结合,必然会产生特定的样貌与特征:“主权在民、权力制衡、律以致用、法律至上”。
The value of the triple attribute of the modern university “academic, administrative, industrial ” and the value of the rule of law and its mode of operation are interlinked and consistent with each other, and the results and benefits are also highly consistent. Therefore, we should promote the operation mode of the rule of law in the governance of modern universities in our country and realize the function and purpose of the modern university through the inherent, peculiar and complete model of the rule of law. Of course, since the university is a special social organization and the rule of law is also a special mode of governance, the combination of a special organization and a special mode of governance inevitably leads to specific features and characteristics: “The sovereignty of the people, Power checks and balances, the law to apply, the law first ”.
