由于我国的量刑程序的缺失,造成量刑失衡的问题越来越突显,量刑程序改革成为我国刑事司法改革的一个重大举措。欲使这一改革健康稳步地进行,应当处理好量刑程序与定罪程序衔接的问题,即量刑程序改革选择何种模式的问题,这也是目前困扰量刑程序改革的关键问题之一。本文通过对我国量刑程序的现状分析和对国外量刑程序模式的介绍,拟提出符合我国量刑程序的模式。
Due to the lack of sentencing procedure in our country, the problem of unbalance of sentencing is becoming more and more prominent. The reform of sentencing procedure has become a major measure of criminal justice reform in our country. In order to make this reform healthy and steady, it is necessary to deal with the convergence of sentencing procedure and conviction procedure, that is, which mode to choose for sentencing procedure reform, which is one of the key problems that plagued sentencing procedure reform at present. Based on the analysis of the status quo of China’s sentencing procedure and the introduction of the foreign sentencing procedure model, this paper proposes to propose a mode that meets the sentencing procedure of our country.
