镇罗营镇五里庙村杨景泉和石作来是前后邻居。石作来家养的一头毛驴,经常拴在杨景泉家必经的通道边的电线杆上,由于通道本来不宽,时常妨碍杨景泉的通行,但碍于情面,杨景泉始终没有制止石作来的做法。去年2月12日上午,杨景泉从过道经过时,由于拴驴的绳过长,占据了绝大部分过道,杨景泉只能贴边而过。恰在此时驴尥(liao)了一个蹶(jue)子,杨景泉为了躲避,向后一闪身,跌倒在地。此后,杨景泉左脚不适,多次要求石作来陪同去医院查治,均遭到其拒绝。无奈之下,杨景泉只得自费治疗,经查是左脚踝软组织损伤,共花去医药费300余元。就损害后的责任承担问题双方产生争议,经村调委会调解,但未成功,主要是石作来不愿承担任何责任。无奈,杨景泉来到司法所求助,再次要求调解。
