但凡有不同利益的地方,就有可能产生矛盾和争端,这是市场经济的一般规律,当然在国际贸易中也不例外。事实上,关贸总协定在某种意义上就是为解决国际贸易中的争端而产生的,而 WTO则更进一步完善了关贸总协定的争端解决机制,使之更具有强制性、约束力。所以,前世贸组织总干事鲁罗杰曾说:“如果不提及争端解决机制,任何对 WTO 成就的评论都是不完整的。从许多方面讲,争端解决机制是多边贸易体制的重要支柱,是WTO 对全球经济稳定作出的最独特的贡献。”那么,新的争端解决机制是一个什么样的机制?它有哪些特点昵?
Whenever there are different interests, conflicts and disputes may arise. This is a general law of the market economy and is certainly not an exception in international trade.
