《物权法》确立了预告登记制度,凡进行了预告登记的不动产,如果没有经过权利人同意而处分的,不发生物权效力。这一制度有利于维护购房人的合法权益,稳定市场交易秩序。但是,从我国法律体系中考察,可以发现这一新的法律制度与其他制度存在冲突。其中,比较明显的就是与工程优先受偿权的冲突。通过对两种制度性质的考量可以得出建设工程优先受偿权应优于预告登记请求权的结论。同时,我国建设工程优先受偿权有待完善。
“Real Right Law” established a notice of advance registration system, where the advance notice of real estate, if not without the consent of the obligee and punished, no right of title effect. This system is conducive to safeguarding the legitimate rights and interests of buyers and stabilizing market order. However, judging from our legal system, we can find that this new legal system conflicts with other systems. Among them, the obvious is the conflict with the engineering priority claim. Through the consideration of the two system nature, we can draw the conclusion that the construction project priority right of compensation should be superior to the right of advance notice of registration. At the same time, China’s construction project priority right to be resolved.
