由于港口交通管理体制的特殊性,港口货物作业实行合同化管理是近几年才发展起来的事情。2001年1月1日,交通部根据《合同法》颁布实施了《水路货物运输规则》、《港口货物作业规则》(以下简称“新两规”),其中合同部分是“新两规”中的重要内容。我们应该认识到“新两规”作为部门规章的局限性。从它的一些条款看,所包含的港口业务内容还不是十分的完备,特别是对关于集装箱码头货物作业的规定较少,涉及的条款也比较笼统,因此,集装箱码头货物作业合同又不能完全依照它而签定,这就要求我们集装箱码头从业人员在正确实施“新两规”的基础上,认真学习合同法,努力钻研集装箱码头业务,在实施集装箱码头货物作业合同过程中,力争做到合同种类齐全,内容全面,使签订合同双方满意,通过合同最大限度的保护集装箱码头经营人的合法利益。
