本文对《劳动合同法》区域实施中的困境以及如何应对进行分析,论证地方劳动合同法实施是中央劳动合同立法改革的内驱力之一,中央劳动合同立法又直接影响地方法律实施。进而指出中央立法应以社会为基础,重视地方需求,加强立法的可操作性;地方在法律实施过程中要遵守《立法法》,通过合理性解释,补充中央立法不足,维护法律权威性。
This article analyzes the difficulties and how to deal with the implementation of the Labor Contract Law, and demonstrates that the implementation of the local labor contract law is one of the driving forces in the reform of the legislation of the Central Labor Contract. The legislation of the Central Labor Contract directly affects the implementation of local laws. Furthermore, it points out that the central legislation should be based on the society, attach importance to the local needs and enhance the maneuverability of legislation. The local government should abide by the “Legislation Law” during the process of law enforcement and supplement the inadequacy of the central legislation through the reasonable explanation to safeguard the legal authority.
