一、辩护书的性质与特点辩护书是辩护律师对所辩护的案件的结论性意见,是对某一案件如何认定事实和适用法律的基本观点,也是律师全部劳动成果的集中体现。它对于辩护律师来说,其重要性相当于检察院的起诉书和法院的判决书。辩护律师要使自己的正确的辩护意见易于被法庭和听者所接受,关键在于把辩护的意见或观点有效地表达出来。所以,辩护书既是律师在法庭上发言的依据,又是法院制作判决书的参考材料。辩护书作为一种特殊的司法文书,其文体的特点主要表现在以下三点:1、合法性。辩护书必须以法律为依据,所辩之论要有鲜明的法律观点,即言之
