我国刑事诉讼法对刑事审判监督程序的规定,从形式上看,它是一个完整的体系,但从实质上看,这些规定过于粗略,在司法实践中不便于操作,导致认识不一,做法各异,影响了法律的统一实施,也拖延了对申诉案件的及时、有效地处理。近几年来,尽管最高人民法院、最高人民检察院作过一些司法解释,但只能作权限范围内的解释,不可能越俎代庖,对条文进行修改或补充,终究显得力不能及。因此,修改和完善刑事审判监督程序已是我国法制建设进一步发展的客观需要。在此,笔者不揣浅陋,就刑事审判临督程序的修改和完善提出一些不成熟的看法,供立法者参考。
In terms of form, it is a complete system. However, in essence, these provisions are too rough and are not easy to operate in judicial practice, which leads to different understandings and different ways of implementing the criminal trial. Different, affecting the uniform implementation of the law, but also delayed the timely and effective handling of appeal cases. In recent years, although the Supreme People’s Court and the Supreme People’s Procuratorate have made some judicial interpretations, they can only interpret within the limits of their rights and can not substitute for the provisions of the articles. Therefore, to amend and perfect the procedure of criminal trial supervision is an objective need for the further development of legal construction in our country. Here, I do not clumsy, put forward some immature views on the amendment and improvement of the Provisional Provisional Procedure for Criminal Judgment, for the legislator’s reference.
