在房价过快上涨的背景下,2010年国家出台房产新政,各地限贷、限购政策随之出台。由于对法律规定及司法解释理解与执行的不统一,全国各地对房产新政引发的退房案件裁判各异,不利于引导人们理性购房。原因在于法院普遍调解解决纠纷弱化了司法规则;民意对司法的侵蚀,使司法不能有效回应;法律规则本身的纠结影响了裁判的统一。只有正确辨析房产新政的法律性质,才能找到规范统一司法的路径。为此要警惕因过度调解而牺牲规则,因提倡调解而丧失原则,因迁就民意而回避法则。建设法治社会,司法不仅应考虑社会效果,更要考虑社会预期及裁判导向。
