商品化权是现代社会经济生活中出现的一种新型权利,英美国家在20世纪50年代才有判例涉及这一问题。我国没有规定独立的商品化权,对此问题的探索刚刚起步。本文以去年沸沸腾腾的乔丹案审判中的困惑为起点,探究国外对商品化权的规定及其权利结构,分析我国以《著作权法》、《商标法》、《反不正当竞争法》等特别法保护商品化权的缺憾,结合商品化权的本质,论述我国设立独立商品化权的必要性。
The right to commercialization is a new type of right emerging in the economic life of modern society. Only a few precedents from the Anglo-American countries involved this issue in the 1950s. Our country does not stipulate an independent right to commercialize and the exploration of this issue has just started. This article starts with the jittery in the booming Jordan case last year and explores the foreign regulations on the right of commercialization and the structure of its rights. The author analyzes the law of Copyright Law, Trademark Law and Anti-Unfair Competition Law in our country. Special Law to protect the shortcomings of the right to commercialization, combined with the essence of the right to commercialization, discusses the necessity of establishing an independent commercialization right in our country.
