文化产业作为一种“内容产业”离不开国家对于知识产权的保护。在全球经济文化一体化的环境下,“十二五”时期我国关于知识产权保护与文化遗产保护法律法规的效率成为建构国家文化产业品质的基础。由于我国文化产业成长于世纪之交的重大社会转型过程中,具有特殊的成长前提,对于知识产权和文化遗产的保护存在较为紧迫的要求。本文对我国文化产业关系最为密切的知识产权和文化遗产法律法规体系进行了全面的梳理,探究知识产权和文化遗产法律法规体系发展及其与文化产业发展之间的关系,讨论了知识产权与文化遗产法律法规建设对我国文化产业发展的价值与作用。
Cultural industry as a “content industry ” can not be separated from the state for the protection of intellectual property rights. In the context of global economic and cultural integration, the efficiency of laws and regulations on the protection of intellectual property and protection of cultural heritage in our country during the “Twelfth-Five-Year Plan” has become the basis for building the quality of the national cultural industry. Due to the special premise of the growth of China’s cultural industry during the major social transformation at the turn of the century, there are more pressing requirements for the protection of intellectual property and cultural heritage. This paper comprehensively reviews the laws and regulations of intellectual property and cultural heritage which are most closely related to China’s cultural industry, explores the relationship between the development of laws, regulations and systems of intellectual property and cultural heritage and the development of cultural industries, and discusses the relations between intellectual property and culture The Value and Function of Inheritance Laws and Regulations on the Development of Chinese Cultural Industry.
