人们为什么服从法律是建构法治的前提问题。服从发生的基本类型是主动服从和被动服从,基本变量是权力和利益,发生机制是奖励—惩罚机制,这种机制就是按照认知系列和序列的方式对法律信息进行加工,核心就是利益主导法律信息的编码化、主导信息整合、主导权力预警。对于正处于利益多元化的转型中国社会而言,必须遵行法律服从产生的内在机制和过程,将“权利本位论”深入推进到法律信息加工的整个过程之中,建构权力保护权利和权力服从法律的信息、重构权利的德性基础、创新和健全权利的表达机制并促进权利的包容性发展。
