一、基层工商执法办案现状及存在问题以西门工商所查办案件为例,该所2013年共立案查处各类经济违法案件18宗,结案18宗。案件呈现出一般性案件多,案件类型缺乏多样性;低端领域案件多,高端领域案件少的特点。(一)无照、超经类案件所占比例较大。2013年该所查办的的违法案件包括无照经营案、超经营范围案、不正当竞争案、食品违法案、产品质量违法案、商标违法案、广告违法案等类型,其中无照及超经案件15宗,占案件办结案件总数83%。案件类型非常单一。
I. Status Quo and Existing Problems of Grass-Roots Industrial and Commercial Enforcement Cases Taking the cases investigated by Ximen Industry and Commerce Bureau as an example, in 2013, the institute investigated 18 cases of various economic illegal cases and closed 18 cases. The cases show a large number of general cases and a lack of diversity in the types of cases. There are many cases in the low-end field and few cases in the high-end field. (1) There is a large proportion of unlicensed and super-type cases. In 2013, the investigated and handled illegal cases included unlicensed operation cases, super business scope cases, unfair competition cases, food illegal cases, product quality illegal cases, trademark illegal cases and advertisement illegal cases, of which the unlicensed and ultra- 15 cases, accounting for 83% of the total number of cases handled. The type of case is very simple.
