刑事立案程序主要的功能就是对刑事侦查程序的控制,保障公民权利,但严苛的立案程序对于打击犯罪却起到抑制作用,不利于刑事诉讼整体功能的实现。立足我国现行刑事司法体制,对我国刑事立案制度的改革有必要保留独立的立案程序、确立合理的立案标准、明确初查的法律地位、加强检察院的立案监督。
The main function of criminal procedure is to control the procedure of criminal investigation and protect the rights of citizens. However, the harsh procedure of filing a case has an inhibitory effect on the fight against crime, which is not conducive to the realization of the overall function of criminal procedure. Based on the current criminal justice system in our country, it is necessary to keep an independent case-filing procedure for the reform of the criminal case-filing system in our country, establish a reasonable standard of filing the case, clarify the legal status of preliminary investigation and strengthen the supervision over the case filing by the procuratorate.
