欧洲人权法院对“裁量余地原则”的保守理解以及对艺术作为特殊表达方式的缺乏认同,导致它屡次丧失为表达自由、尤其艺术表达自由明确更宽容规则的机会。相比它对所谓不道德及涉及宗教艺术表达的苛刻对待,它对带有政治意图艺术表达的另眼看待和绝对保护给人以不同形式的表达自由有高低贵贱之分的错误印象。对现代艺术的潜意识排斥、对缔约国人权进行实质监督和强制管辖意愿的缺失,使欧洲人权法院在表达自由裁判上坚守着保守立场。
The European Court of Human Rights’s conservative understanding of the “principle of discretion” and the lack of recognition of art as a particular form of expression have led to its repeated loss of opportunities for clear and more tolerant rules for freedom of expression, especially artistic expression. Compared with its harsh treatment of the so-called immoral and religious art expression, its unqualified and absolute protection of art with a political intention gives the false impression that people have different meanings in different forms of freedom of expression. The subconscious exclusion of modern art, the lack of material supervision of the State party’s human rights and the will to impose a strict jurisdiction have left the European Court of Human Rights with its conservative stance in the expression of free judgments.
