对于苏格拉底之死这一事件,人们从不同的角度对其进行了思考和解读,包括政治学、伦理学、哲学、神学等视角。苏格拉底之死在人类文明史上不仅是一个重要的政治哲学事件,也是一个重要的法律事件。从法理学的角度对其进行解读,可以揭示这一事件所蕴含的苏格拉底的法律思想和守法精神。苏格拉底的法律思想具有着社会契约论、实证分析主义法学、功利主义法学以及自然法学的色彩,成为后世法学思想的重要源头。
For the incident of the death of Socrates, people think and interpret it from different angles, including political science, ethics, philosophy and theology. The death of Socrates is not only an important political and philosophical event but also an important legal event in the history of human civilization. Interpreting it from the perspective of jurisprudence can reveal Socrates’ legal thinking and law-abiding spirit implied in the incident. Socrates’ legal thoughts have the characteristics of social contract, positivist analytic jurisprudence, utilitarian jurisprudence and natural law, which have become the important source of later legal thought.
