在创新社会治理的时代要求下,要想确保慈善事业健康发展,必须对作为慈善事业核心之慈善行为进行全方位、系统、立体的规制与监管。本文认为,对慈善行为的规制与监管是一个一体两面的问题,对慈善行为的规制旨在从正面引导慈善行为趋向规范化、标准化与程序化,内容包括法律规制、政策规制与内部规制;对慈善行为的监管旨在从反面预防慈善行为越位以及矫正和处罚越位的慈善行为,内容包括政府监管、社会监管与行业监管。
Under the requirements of the times of innovating social governance, in order to ensure the healthy development of charities, it is necessary to regulate and supervise all-round, systematic and three-dimensional charity acts as the core of charity. This paper argues that the regulation and supervision of charity behavior is a one-sided and two-sided problem. The regulation of charity behavior aims to lead the charity behavior from the positive to the standardization, standardization and proceduralization, including legal regulation, policy regulation and internal regulation; Behavioral regulation aims to prevent vice charities offside and corrective and punish offside charity, including government regulation, social supervision and industry regulation.
