保密性是商事仲裁的一个优良传统和制度优势,关于仲裁保密性的规定,我国现行的仲裁法律及仲裁规则存在着立法疏漏,即当事人隐私规定的缺失、公告送达方式的滥用皆损害了仲裁的保密性;又因仲裁与诉讼之间程序衔接不畅,法院对仲裁的支持和监督演变成了司法对仲裁保密性的不当干预。如何保全仲裁的保密性优势,填补立法漏洞,化解司法干预与仲裁保密性之间的冲突是本文的话题。
Confidentiality is a fine tradition and institutional superiority of commercial arbitration. As to the provisions on the confidentiality of arbitration, the existing arbitration laws and arbitration rules in our country are subject to legislative omissions, that is, the lack of privacy provisions of the parties and the abuse of the mode of delivery of advertisements, Because of the poor connection between arbitration and litigation, the court’s support and supervision of arbitration has evolved into an improper judicial intervention on the confidentiality of arbitration. How to preserve the confidentiality advantage of arbitration, fill in the loopholes in legislation and resolve the conflict between judicial intervention and the confidentiality of arbitration are the topics of this article.
