美国宪法确立分权与制衡作为美国政治制度,20世纪大量的立法委任是美国经济、社会发展的客观要求。解释委任立法与国会立法之间关系,监督与控制立法权委任是美国最高法院面临的重要问题。美国最高法院通过大量立法委任判例,完善立法委任学说或者观点,通过司法解释、立法委任标准以及程序等措施,保障立法委任在分权原则框架下的正常运行,维护美国社会的稳定与发展。
The United States Constitution Establishes Decentralization and Checks and Balances as the United States Political System. The large number of legislative appointments in the 20th century is an objective requirement of U.S. economic and social development. Explaining the relationship between appointing legislation and parliamentary legislation, and supervising and controlling the appointment of legislative authority are important issues facing the Supreme Court of the United States. The Supreme Court of the United States, through a large number of legislative cases, has perfected the doctrine or viewpoint of legislative appointment, and has ensured the normal operation of legislative commission under the principle of separation of powers and maintained the stability and development of American society through such measures as judicial interpretation, standards of legislative appointment and procedures.
