辩诉交易是在美国诉讼实践中广泛使用的诉讼制度,其在节约诉讼成本和缩短诉讼时效方面有很大的优势,值得我国司法实践借鉴。但这种检察官和被告人间的交易,往往因为追求各自的利益而忽视被害人的利益,本文将简单讨论如何更好构建中国式辩诉交易。
Plea bargaining is a litigation system that is widely used in litigation practice in the United States. It has great advantages in saving litigation costs and shortening the limitation of litigation. It is worth our reference for judicial practice in our country. However, this kind of transaction between prosecutors and defendants often neglects the interests of the victims for their own interests. This article will briefly discuss how to better construct Chinese-style plea bargaining.
