明清时期死罪数量众多、各从其类;执行方式繁杂、用刑严峻;适用程序严密、皇权专制。但随着资本主义的崛起,封建专制王权不可逆转地衰败,近代化浪潮对传统法制造成危机,变法修律成为救亡图存的一部分,刑罚文明、刑罚人道的观念亦在争论中渐入人心。
