文章对集体林权制度改革中农民享有的林地承包经营权、林木所有权、处置权、收益权和民主参与权五项权益进行了界定,梳理了相关法律和政策依据,并阐述了衡量各项权益实现的要点。在对陕西省和云南省进行实地调研的基础上,分析了各项权益的实现途径,从宏观和微观层面总结了影响农民权益实现的主要因素,并提出了改善农民权益实现状况的政策建议。
This article defines five rights and interests of forestland contractual management right, forest ownership, disposition right, profit-making right and democratic participation right enjoyed by peasants in the reform of collective forest tenure system, and combs the relevant laws and policies, and elaborates the measures of various rights and interests Key points to achieve. On the basis of field investigation in Shaanxi Province and Yunnan Province, this paper analyzes the ways of realizing various rights and interests, summarizes the main factors that affect the realization of peasants ’rights and interests at the macro and micro levels, and puts forward policy suggestions to improve the peasants’ rights and interests.
