和谐社会是中国特色的社会主义社会的本质属性,其理念具有丰富内涵,深刻影响着国家治理方式,也影响着社会生活的各个方面。法治是和谐社会的应有之义,是和谐社会构建的前提。没有法治的社会不可能是和谐的社会。而法治社会的实现又离不开司法权力的公正行使。司法的公正恰是司法的灵魂。所以,和谐社会对司法公正的要求是内生的,司法公正是和谐社会构建的应有之义。和谐社会是利益多元的社会,其社会主体的利益诉求亦是多元的。司法公正则能消解不同社会主体利益诉求的纷争,达致多元利益诉求的共存,这无疑使得司法公正在和谐社会的构建中显得尤为重要。
A harmonious society is an essential attribute of a socialist society with Chinese characteristics. Its concept has rich connotation and profoundly influences the ways of state administration and affects all aspects of social life. The rule of law is the proper meaning of a harmonious society and the prerequisite for building a harmonious society. A society without the rule of law can not be a harmonious society. The realization of a society ruled by law can not be separated from the just exercise of judicial power. Just justice is the soul of justice. Therefore, the requirement of harmonious society for the judicial fairness is endogenous, and the judicial fairness is the proper meaning of building a harmonious society. A harmonious society is a society of diverse interests. The interests of social subjects are also diverse. Judicial fairness can dispel disputes between interests of different social subjects and achieve the coexistence of multiple interest demands. This undoubtedly makes judicial fairness particularly important in the construction of a harmonious society.
