[目的/意义]对国内现存的14部地方图书馆法规和规章进行比较研究,总结出其对我国图书馆立法建设的启示。[方法/过程]从图书馆法规和规章制定目的、适用范围、图书馆定义、图书馆经费、图书馆服务、图书馆设置、文献资源建设与布局、图书馆事业管理体制、人员任命9方面对14部地方图书馆法规和规章进行全面分析,发现我国地方图书馆法规和规章中的一些特点和存在的一些问题。[结果/结论]我国图书馆立法建设应该注重以下方面:图书馆法规和规章需要随着社会的发展而及时修订;图书馆经费数量规定应具体化、数量化、指标化;加大知识产权保护力度;增加危机管理相关条款;法规和规章中增加政府部门的法律职责。
[Purpose / Significance] To comparatively study the laws and regulations of the 14 local libraries in our country and summarize their enlightenment on the legislative construction of our country’s libraries. [Methods / Processes] From the aspects of purpose and scope of library regulations and rules making, scope of application, definition of library, library funding, library service, library setting, construction and layout of literature resources, management system of library business and appointment of staff A total of 14 local library regulations and rules to conduct a comprehensive analysis found that the local library regulations and rules of our country some of the characteristics and problems. [Results / Conclusion] The legislative construction of our country’s libraries should focus on the following aspects: Library regulations and rules need to be revised in time with the development of society; the provisions on the amount of funds for libraries should be specific, quantitative and index-based; and the protection of intellectual property Efforts to increase the relevant provisions of the crisis management; laws and regulations to increase the legal responsibilities of government departments.
