本文主要涉及三个内容:第一,法律经济分析是法律实用主义研究方法的一个分支。一个国家的法律职业群体和学者在使用经济分析时,必须要考虑其制度结构和法律文化是否能容纳这种方法;第二,经济学的面目可能是可怕的,可能令人心生畏惧,但同时它也可能是使法律变得更为清晰、更符合直觉的有效工具;第三,作者目前关注的两个法律经济学问题:司法行为的实证分析,以及,世界经济危机和经济分析(包括法律经济分析)的失败。 This article mainly involves three contents: First, legal economic analysis is a branch of legal pragmatism research method. When using economic analysis, a group of legal professionals and scholars in a country must consider whether its institutional structure and legal culture can accommodate this method. Second, the face of economics may be terrible and may be daunting, but at the same time It may also be an effective tool to make the law clearer and more intuitive.
