我国现行的立法体系中,作为地方性立法的一种特殊形式,自治地区的立法在我国现行的立法体系中占有重要的地位,而这种特殊的立法形式又有其特殊的立法制度。其中,报批制度为民族自治地方的立法活动所特有。同时,这种特殊的立法制度也关系着今后民族自治地方立法成败的关键。本文通过对自治区自治立法中的这一特殊制度的分析,讨论报批制度的优劣。有利于在今后的自治区立法活动中确立一种新的立法制度,使之更好的服务于我国民族自治的立法活动。
In the current legislative system of our country, as a special form of local legislation, the legislation of the autonomous region occupies an important position in the current legislative system of our country, and this special form of legislation has its own special legislative system. Among them, the approval system is unique to the legislative activities of ethnic autonomous areas. At the same time, this special system of legislation also holds the key to the success or failure of legislation in the autonomous areas in the future. This article analyzes the special system of self-government legislation in autonomous region to discuss the pros and cons of approval system. Which is conducive to establishing a new legislative system in the legislative activities of the autonomous region in the future so as to better serve the legislative activities of our national autonomy.
