从我国农村集体土地所有权的使用情况来看,在历史特定时期起到过积极作用。但是在当前经济社会环境大变革的背景下,如果仍沿用计划经济时代模式来确定集体土地使用权,显然不妥。由于考虑到集体土地所有权在具体实践中存在的问题与矛盾,已经制约了我国经济的健康发展,不利于社会法制化的顺利落实。因此,加快农村集体土地所有权的变革,既要维护农民的各项土地权益,也要推动国家的经济发展。
Judging from the use of rural collective land ownership in our country, it has played an active role in the specific period of history. However, in the current context of the great economic and social revolution, it is obviously not proper to use the mode of planned economy to determine the collective land use rights. Considering the problems and contradictions existing in the practice of collective land ownership, it has restricted the healthy development of our economy and is not conducive to the smooth implementation of social legalization. Therefore, to speed up the reform of rural collective land ownership, we must not only safeguard the peasants’ rights to all land, but also promote the country’s economic development.
