作为法律方法论最重要的组成部分,法律解释学要努力为法治的实现提供科学的方法论支撑。为了增强其回应司法实践的能力,法律解释学研究应通过间接参与司法实践的进路,探索更具普适性的法律解释方法的理论模型;应通过直接参与(或“准”直接参与)司法实践的进路,针对具体个案进行分析和论证,并不断修正、改进该理论模型,最终整合出比较贴近中国实际的、具有较强可操作性的、成熟的法律解释规则体系。
As the most important part of legal methodology, legal hermeneutics should strive to provide scientific methodological support for the realization of the rule of law. In order to enhance its ability to respond to judicial practice, the study of legal hermeneutics should explore the theoretical model of a more generalized legal interpretation method through the indirect participation in judicial practice. Participants should be directly involved ) Judicial practice of the approach, analysis and demonstration for specific cases, and constantly revised and improved the theoretical model, and ultimately integrated more closely with China’s reality, with strong maneuverability and mature rules of legal interpretation system.
