1995年《中华人民共和国仲裁法》为涉外仲裁司法监督体制构建的国内和涉外仲裁司法监督双重标准无论是在立法理念上还是在制度设计上,既与国内仲裁不同又与国际上的做法存在差异。涉外仲裁的司法监督问题实质上就是如何处理一国法院与涉外仲裁的关系问题。对涉外仲裁性质以及价值理念的不同取舍直接决定了一国在设置涉外仲裁司法监督体制时的立场。仲裁立法始终在维护法律的公正性和提高法律的效率这一对矛盾之间寻求平衡点,必须树立将公正和效率的协调实现作为涉外仲裁终极价值目标的价值理念才能从全局整体把握我国涉外仲裁司法监督制度建设的方向。我国涉外仲裁司法监督制度的完善在思路上应坚持维护当事人意思自治和自由选择的权利,多借鉴国际经验,以促进仲裁发展为原则。

It is necessary to establish the value concept of coordinating the fairness and efficiency as the ultimate goal of foreign-related arbitration in order to grasp the overall situation of foreign-related arbitration in our country Judicial supervision system construction. The consummation of the system of judicial supervision over foreign-related arbitration in our country should adhere to the principle of safeguarding the autonomy and freedom of choice of parties, and learn more from international experience to promote the development of arbitration.
