上世纪90年代初期住宅用地使用权到期面临续期的问题的出现,使住宅建设用地使用权期间届满的问题再一次被重视。对于国有土地使用权到期的处理,国家的处理办法是以申请续期为主,国家无偿取得为辅。目前采取“两不一正常”的过渡性办法处理,对于是否需要进行登记,是否缴纳续期费用,现存法规仍没有加以规定。
The appearance of renewal of the expiration of the right to use residential land in the early 90s of last century has once again taken seriously the problem of the expiration of the right to use residential land for construction. As to the expiration of the right to use state-owned land, the state’s approach is mainly to renew the application, supplemented by the state’s acquisition without compensation. The current “two different” approach to deal with the transitional, whether the need for registration, whether to pay the renewal fee, the existing laws and regulations still not be provided.
