回族习惯法是回族群众在长期的生产生活实践中形成,并被回族穆斯林共同遵守的思想观念、制度文化和生活规范。回族习惯法所具有的宗教性、义务本位等特征,决定了其与国家制定法在法律精神、制度规范中有着冲突,如何调适回族习惯法与国家制定法,是维护民族地区和谐稳定必须解决好的问题。
The Hui nationality customary law is the ideological concept, institutional culture and living standard that the Hui people formed in the long-term practice of production and life and was obeyed by Hui Muslims. The characteristics of the religious and obligatory standards possessed by the customary law of the Hui state determine that it has a conflict with the state law in the spirit of the law and the norms of the system.
