人民监督员制度在实践操作上包括“三类案件”监督程序和“五种情形”监督程序。人民监督员在对“三类案件”监督评议中,如对不服逮捕的监督评议,体现了人民监督员直接参与司法活动,在宽严相济政策中表现了“宽”的一面,如对拟不起诉,拟撤销案件的监督评议,在宽严相济政策中则表现出了“严”的一面。人民监督员通过监督,推进检察机关公正、文明执法。
