追求实体真实而进行的司法改革现代日本法是由日本固有和西方两种文化和法律传统相互影响而形成的。1860年明冶维新结束了德川幕府的统治,天皇实际掌握了政权。当时,日本试图建立一个能博得国际尊重、终止治外法权和维护民族独立的经济、政治和法律机构,于是,引进了西方法律。从此,日本传统法律开始溶入西方法律,仿照欧洲大陆法律制度。由于当时德国属欧洲强国,日本主要参照德国的法律制度。
Judicial Reform Pursuing Real Truth The modern Japanese law was formed by the interplay between the two cultures and legal traditions inherent in Japan and the West. 1860 The Meiji Restoration ended the rule of the Tokugawa shogunate, and the Emperor actually took power. At that time, Japan was trying to establish an economic, political and legal institution capable of winning international respect, ending extra-legal authority and safeguarding national independence. As a result, Western law was introduced. Since then, the traditional Japanese law began to dissolve Western law, modeled on the continental European legal system. Since Germany was a European power at the time, Japan mainly relied on the German legal system.
