【裁判要旨】在职劳动者与用人单位发生纠纷,劳动者可以行使劳动争议提请处理权,请求行政机关和司法部门给予救济。若用人单位以此为由认为劳动者无故旷工,并滥用了劳动争议提请处理权,则法院应当从劳动者的工时制度、提请争议解决的合理时间和用人单位在纠纷解决过程中的态度三个方面进行司法审查,综合考虑劳动者是否正当行
[Referee motto] Dispute between working laborer and employer, laborers may exercise labor dispute and request handling right, request administrative organ and judicial department to give relief. If the employer, on the ground that the laborer is absent for no reason and abuses the labor dispute to draw the right of processing, the court shall draw the working time system of the laborer, draw the reasonable time of the dispute settlement and the attitude of the employer in the dispute resolution process Judicial review should be conducted on the basis of considering whether the workers are legitimate or not
