平等协商和集体合同制度是我国法律规定的一项劳动法律制度。《劳动法》规定:“企业职工一方与企业可以就劳动报酬、工作时间、休息休假、劳动安全卫生、保险福利等事项,签订集体合同。”“集体合同由工会代表职工与企事业单位行政签订。”《中共中央关于国有企业改革和发展若干重大问题的决定》明确指出:“进一步理顺劳动关系,依法进行平等协商,认真执行劳动合同和集体合同制度。”集体合同是职工与企业就劳动报酬、工作时间、休息休假、劳动安全卫生、社会保险和福利等单项或多项内容,通过平等协商订立的书面协议。平
