《公证法》明确表示了有关公正赔偿责任的处理措施,为有效落实公证司法工作提供了科学合理的根据,在一定程度上推动了司法工作的进行。然而无法否认的一点是,《公证法》的确立并没有很好地考虑到实际工作需求,部分规则缺乏具体的实施意义,特别是公正赔偿责任的过错定义问题,对《公证法》的广泛运用起着一定的阻碍力量。因此本文基于现阶段国内司法工作落实问题的前提下,分析公正赔偿责任的过错含义与认定工作。
The Notarization Law made it clear that the measures concerning fair liability for compensation have provided a scientific and reasonable basis for the effective implementation of notarial and judicial work, which has, to a certain extent, promoted the judicial work. However, it can not be denied that the establishment of Notarization Law did not properly consider the actual work requirements. Some of the rules lacked specific practical significance. In particular, the issue of defining the fault of fair liability and the extensive application of “Notarization Law” Play a certain impediment. Therefore, based on the implementation of the judicial work at home at this stage, this article analyzes the meaning and determination of the fault of just compensation.
