所谓海上红十字地带,是指在海上武装冲突中,由敌对双方在冲突之前或冲突开始之后协商确立的仅用于进行交换、救治伤者病者等人道主义活动的一定范围的公海或专属经济区外围区域。海上红十字地带作为英阿马岛海战的创新性实践,因契合国际人道法的原则和精神具备了合法性,又以其独特的性质和功用而被国际社会普遍认可,并为习惯国际人道法所承认。英阿两国灵活运用国际法服务军事斗争需要的理念应该为我们所借鉴。着眼未来海上军事斗争需要,在具体设立海上红十字地带时,要从时机、区域、意志、使命和权利义务五个要素去考虑,从实施程序和救济程序两个方面展开。
