法理学的使命在于为一个时代的法律生活建构一个深广的、一元化的理念世界,以之统摄、承载法律的有序运动。能够支撑一个时代法律生活的法理一定是与该时代的精神相契合的。三十年来逐渐形成的开放性的市场经济、理性的法治政治、以人为本的和谐社会要求中国法理学要实现从革命到建设、从斗争到和谐、从政本到人本的精神转向。
The mission of Jurisprudence lies in constructing a deep and unified world of ideas for the legal life of an era, and taking it as an example to carry the orderly movement of law. The legal principles that can support the legal life of an era must be compatible with the spirit of the times. The open market economy, the rational law-based politics and the people-oriented harmonious society that have been gradually formed over the past 30 years require China’s Jurisprudence to achieve the transformation from revolution to construction, from struggle to harmony, and from the political-oriented to the humanistic.
