一、引言2015年4月2日,國務院法制辦就國家知識產權局、科技部報請國務院審議的《職務發明條例草案(送審稿)》(簡稱《草案(送審稿)》)公開徵求社會各界意見。作為激勵發明人從事技術創新的重要措施,同時也作為發明人對職務發明享有的主要權利,《草案(送審稿)》在第四章集中規定了獎勵報酬,體現了約定優先原則為主,最低標準原則為輔的保障制度。2015年10月1日實施的修訂後的《促進科技成果轉化法》(簡稱《轉化法(2015)》)也規定了類似的制度。本文試圖對職務發明人獎勵和報酬的原則進行分析,並針對司法實踐進行評述。
I. INTRODUCTION On April 2, 2015, the Legislative Affairs Office of the State Council publicly solicited public opinions on the “Draft Invention of Inventions (Draft for Review)” (Draft for Approval) submitted by the State Intellectual Property Office and Ministry of Science and Technology for consideration by the State Council Views from all walks of life. As an important measure to motivate the inventor to engage in technological innovation and as the main right enjoyed by inventors as a service invention, the draft (draft for review) stipulates the incentive remuneration in the fourth chapter, which reflects the priority of agreement, The principle of minimum standard supplemented by the protection system. A similar system is also provided for in the revised Act on the Promotion of Scientific and Technological Achievements (“Conversion Act (2015)”) implemented on October 1, 2015. This article attempts to analyze the principle of rewards and remuneration of service inventors and comments on judicial practice.
