大陆法系的鉴定制度和英美法系的专家证人制度各有优劣。目前,这两种制度有相互借鉴、逐步融合的趋势。我国现有的鉴定制度漏洞百出、问题严重,更应向这一趋势靠拢,借鉴英美法系的专家证人制度对我国的鉴定制度进行改革和完善。而专门辅助人制度的确立,无疑是这一借鉴、融合过程中的良好开端和成功典范。本文对我国民事诉讼中的专门辅助人制度进行了阐述,并提出了自己的一点完善意见。
The system of appraisal of the civil law system and the expert witness system of the common law system have advantages and disadvantages. At present, the two systems have a tendency of mutual reference and gradual integration. The existing appraisal system in our country is full of loopholes and serious problems. Instead, we should move closer to this trend and use the expert witness system in common law system to reform and perfect the appraisal system in our country. The establishment of a system of specialized supporters undoubtedly serves as a good example for this reference and integration process. This article elaborates on the system of special supporters in civil litigation in our country and puts forward some suggestions on how to perfect it.
