在科学技术迅猛发展的新时期,文化的发展日新月异,然而,文化立法在中国起步较晚,法制建设水平无法与文化发展的速度相适应。如何将文化全面纳入法制轨道,建构符合中国国情的文化立法框架具有现实的重大意义。在借鉴国外先进经验的基础上,根据文化固有的内在逻辑,构建既符合文化立法固有发展规律同时又具有中国特色的文化立法基本框架。
In the new era of rapid development of science and technology, the development of culture is changing rapidly. However, cultural legislation started relatively late in China and the level of legal system construction can not be adapted to the speed of cultural development. How to fully integrate culture into the legal track and construct a cultural and legislative framework that is in keeping with China’s national conditions are of great realistic significance. On the basis of drawing on advanced foreign experience and basing on the inherent logic of culture, we should construct the basic framework of cultural legislation that meets the inherent law of development of cultural legislation as well as has Chinese characteristics.
