一、制定部门行政机关组织法规的必要性在我国,根据宪法、国务院组织法、地方各级人民政府组织法的有关规定,国务院和县级以上地方各级人民政府有权管理本行政区域内的经济、教育、科学、文化、卫生、体育事业,环境和资源保护、城乡建设事业,财政、民政、公安、民族事务,司法行政、监察、计划生育等行政工作.而事实上,绝大多数这些具体的行政工作都是靠国务院和县级以上地方各级人民政府所属的部门行政机关去实际贯彻落实的.因此,所有这些部门行政机关依法行政的状况就基本上反映出我国整个国家依法行政的状况.随着我国改革开放建设的不断深入和扩大,必将对部门行政机关依法行政提出越来越高的要求.但由于受某些因素的影响,现阶段我国部门行政机关依法行政的状况还有待于进一步改进.比如,有的部门行政机关由于职责权限规定不明,以致于该部门行政机关工作人员(以下称公务员)客观上无法严格依法行政,有时还会与别的部门行政机关发生权限争议,这也使得公民、法人或其他组织(以下称行政相对人)不能有效地保护自己的合法权益.又比如,不少部门行政机关及其公务员在行使行政职权时,由于缺乏程序性规范的约束,以致于各种超越职权、滥用职权等违反法律规范的行政行为时有发生.诸如此类因素的存在,都不同程度?
