劳顾问:我单位有一职工一九六八年十二月参加工作,一九九一年四月入本企业,一九九五年八月二十八日至一九九六年一月入院做左眼视膜网脱落手术,至今未回单位上班。一九九六年一月公司实行固定工转制时与该同志签订五年劳动合同。一九九六年三月该同志医疗期已满,我司多次以书面形式通知其本人到规定医院进行医务劳动鉴定,但到如今该同志在无正当理由的情况下仍拒绝进行医务劳动鉴定和上班工作。我单位欲与其终止劳动合同,应如何办理有关手续。请答复,谢谢。
