随着近些年来社会主义市场经济的飞速发展,国内终止劳动合同的现象渐渐增多。而劳动经济补偿金是企业解除劳动合同时所需支付给劳动者的相应经济补偿,它对维护劳动者日后的生活、入职等权益有着不可忽视的意义。然而,因为我国劳动经济补偿金制度立法仍不够完善,并在实际应用中存在不少问题,所以抓紧完善我国的劳动经济补偿金制度成为保护劳动者权益的首要任务。本文不但指出了我国劳动经济补偿金制度现存的不足之处,还提出了对应的完善措施,希望能为建立、健全我国劳动经济补偿金制度提供参考价值。
With the rapid development of the socialist market economy in recent years, the domestic termination of labor contracts has gradually increased. The economic compensation for labor is the corresponding economic compensation that the enterprise needs to pay to the laborers to terminate the labor contract. It has a great significance for safeguarding the rights and interests of laborers in the future. However, because the legislation of labor compensation system in our country is still not perfect enough and there are many problems in practical application, it is the primary task to pay close attention to perfecting the labor compensation system in our country to protect the rights and interests of laborers. This article not only points out the existing deficiencies of China’s labor economic compensation system, but also puts forward corresponding measures for improvement, hoping to provide a reference value for establishing and improving China’s labor compensation system.
