高校工会的主要职责是维护教职工的合法权益,充分发挥其桥梁纽带作用,帮助教职工投身于教育事业,切实开展行之有效的维权活动。然而,由于工会组织法律地位不独立、高校内部改革不断深入等原因,导致目前高校工会出现了职能缺位的局面,使得工会作用不能充分发挥。本文将从当前高校工会在维权过程中的现实困境出发,对高校工会维权的现实困境产生的法律原因进行探析,并提出相应的法律对策,以期有一定借鉴意义。
The main duties of trade unions in colleges and universities are to safeguard the legitimate rights and interests of faculty and staff, give full play to their role as a bridge, help faculty members devote themselves to education, and effectively carry out effective rights protection activities. However, due to the fact that the legal status of the trade unions is not independent and the internal reform of colleges and universities is deepening, the unavailability of labor unions in colleges and universities has led to the failure to give full play to the role of trade unions. Based on the current difficult predicament of trade unions in colleges and universities during the process of safeguarding rights, this article analyzes the legal reasons for the real predicament of labor unions in colleges and universities, and puts forward corresponding legal measures in the hope of some reference.
