作为社会治理的重要方面,社会管制领域内的全民共建共享机制能否以及如何构建是一个富有争议的话题。文章在审视社会管制特性的基础上,通过透视现代社会管制问题的复杂性,回答了全民共建共享机制何以必要的问题;在引入过程分析理论的基础上,通过解析社会管制的流程和环节,回应了全民共建共享机制如何构建的问题。文章认为,通过共建共享机制的设计,实现“全民”全过程的社会管制参与,达成政府、社会和市场的各类主体和各种力量的合作共治,是实现社会管制公共利益最大化之价值目标的根本途径。
