利益平衡的本质是立法和司法从程序理性向实质理性的进化,是法院贯彻科学发展观、落实司法为民的重要举措。在新的历史阶段,法院要以科学发展观指导落实司法为民,就必须认识到利益平衡对社会稳定的重要性。2009年6月12日,上海市第一中级人民法院与上海财经大学联合召开了第二届院长论坛暨“利益平衡与司法公正”研讨会。最高人民法院研究室副主任孙佑海、中共上海市委政法委副书记林国平、上海市高级人民法院党组副书记、副院长沈志先、上海财经大学党委书记马钦荣、上海财经大学副校长周仲飞等出席会议,来自长江三角洲地区的15家中级法院的院长参加会议并发表主题讲演,华东政法大学校长何勤华、北京理工大学法学院院长谢晖、武汉大学环境法研究所所长、湖北省人大常委王树义、《法学研究》杂志社社长张广兴、中国社会科学院法学研究所研究员刘作翔等应邀作专家发言。会议围绕“司法过程中利益平衡的价值与意义”、“金融危机背景下利益平衡原则的实践运用”、“审判活动中利益平衡原则的规范化”三个主题展开,对司法过程中的利益平衡问题进行了全方位的探讨。与会的法院院长及专家学者的发言契合实际,充满真知灼见。
The essence of the balance of interests is the evolution of legislation and judicature from procedural rationality to substantive rationality. It is an important measure for the courts to implement the scientific concept of development and implement justice for the people. On June 12, 2009, Shanghai No. 1 Intermediate People’s Court and Shanghai University of Finance and Economics jointly held the 2nd Dean’s Forum and the Symposium on “Interests Balance and Justice”. Sun Youhai, deputy director of the Supreme People’s Court Research Office, Lin Guoping, deputy secretary of the CPC Shanghai Municipal Committee and Political Science and Law Committee, Shen Zhixian, deputy party secretary and vice president of Shanghai Higher People’s Court, Ma Qinrong, party secretary of Shanghai University of Finance and Economics and Zhou Zhongfei, vice chancellor of Shanghai University of Finance and Economics attended the meeting. Dean of 15 Intermediate Courts in the Yangtze River Delta attended the symposium and delivered a keynote speech. He Qinhua, President of East China University of Politics and Law, Xie Hui, Dean of Law School of Beijing Institute of Technology, Director of Institute of Environmental Law of Wuhan University, and Wang Shuyi, Standing Member of Hubei Provincial People’s Congress, Zhang Guangxing, president of Law Research magazine and Liu Zuoxiang, a researcher at the Institute of Law, Chinese Academy of Social Sciences, were invited to give speeches. The conference focused on the three topics of “the value and significance of the interest balance in the judicial process”, “the practical application of the principle of balance of interests under the financial crisis”, and “the standardization of the principle of balance of interests in trial activities” The process of balancing the interests of all-round discussion. The statements made by the court presidents and experts and scholars attending the meeting are realistic and full of insights.
