我国是法治国家,但由于法律制度的不完善,难免会出现一些冤假错案,当案件上升到刑事高度时,往往会牵涉到人命问题。冤假错案的一个重要因素在于当地司法机关不够公正,为解决这一问题,有必要建立异地审查制度。本文围绕刑事申诉异地审查,先论述了其启动条件和原则,并对其机构确立和基本程序进行了分析,然后对其配套措施和注意事项加以探讨,旨在完善我国法律体系。
China is a state governed by law. However, due to the imperfect legal system, some unjust and false cases will inevitably occur. When the case rises to the criminal level, it often involves human lives. An important factor of unjust and wrong cases is that the local judiciary is not just enough. To solve this problem, it is necessary to establish a system of censorship of off-site. This article focuses on the remote review of criminal appeals, first discusses its starting conditions and principles, and analyzes the establishment of its institutions and basic procedures, and then discusses its supporting measures and precautions to improve China’s legal system.
