我国现行的精神病收治制度不完善,导致“被精神病”现象频频出现,不仅威胁到社会公共安全,也使得公民的基本权利得不到应有的保障。本文分析了我国“被精神病”现象的原因,参考国外精神病强制医疗方案,提出了完善精神病强制医疗分立法构想。
The imperfect system of receiving psychosis in our country leads to the frequent appearance of “being mentally ill”, which not only threatens social public security but also prevents the basic rights of citizens from being properly protected. This paper analyzes the causes of the phenomenon of “being mentally ill” in our country and refers to the compulsory medical scheme of mental illness in foreign countries and puts forward the conception of perfecting the separation of psychiatric and compulsory medical treatment.
